Refunds and Cancellation Policy
Effective date: December 30, 2025
This policy applies to services and digital products provided by Tristan Salisbury (operating as BearPack Online Services, "BearPack"), unless a signed agreement states otherwise.
Digital Products (Software Downloads)
- All sales final after download access: Once you receive download access and successfully download the product, all sales are final. No refunds will be issued.
- Download link failure: If your download link never works or expires before you can access it, contact us within 7 days of purchase for a re-issue or full refund.
- Technical issues: We do not provide refunds for deployment issues, compatibility problems, or third-party service dependencies after download. Technical support is available separately.
- Disputed charges: If you initiate a chargeback without contacting us first, we will dispute it with evidence of product delivery.
Refund Examples (Clarification)
Refundable scenarios (contact within 7 days):
- Download link never worked or was invalid
- Download link reissue failed after multiple attempts
- We never sent you a download link (prove via email receipt)
Not refundable (no exceptions):
- You downloaded successfully but cannot deploy it yourself (third-party infrastructure/Node.js knowledge required)
- Third-party services changed or are no longer available (YouTube, Spotify, Discord API availability)
- You need custom modifications or integration help (purchase Technical Support add-on)
- Your server/hosting configuration doesn't meet minimum requirements (you are responsible for setup)
- You changed your mind after downloading
Services (Custom Development)
Because we provide custom professional services, outcomes depend on scope and collaboration. This policy is designed to be clear and fair.
1) Fixed-scope projects
- Before work begins: If you cancel before kickoff, any deposit may be refundable minus admin costs (if stated in your SOW/invoice).
- After kickoff: Fees for work performed are non-refundable. If you cancel mid-project, you are responsible for work completed and committed costs.
- Delivery disputes: If you believe deliverables do not match the agreed scope, you must notify us in writing within 5 business days of delivery. We will work in good faith to resolve scope-aligned issues.
2) Milestone projects
- Milestones are billed per the SOW/proposal. Paid milestones are non-refundable once delivered.
- You may pause/cancel future milestones with 7 days written notice; completed or in-progress milestones remain payable.
- We will hand over the current state of work upon request (subject to payment status).
3) Support packs and subscriptions (managed hosting / services)
For ongoing subscription services (including managed hosting, software-as-a-service, support subscriptions), the following applies:
- Billing: Subscriptions renew monthly or at the interval specified at purchase
- Cancellation: You may cancel your subscription at any time with written notice (email)
- Effective date: Cancellation takes effect at the end of your current billing period. You will retain access through the end of that period
- Refunds for early termination: We do not offer refunds for unused portions of the current billing period. For example, if you cancel mid-month, you will be charged for the full month
- Prorated credits: If you upgrade or downgrade mid-period, we will prorate the difference and credit your account toward the next billing cycle (not issued as cash refunds)
- Failed payments: If payment fails, we will attempt to retry according to Stripe's policies. Repeated failures may result in service suspension
- Suspension and termination: We may suspend or terminate your subscription immediately if you violate these Terms or if payment cannot be collected after reasonable attempts
4) Support packs (optional add-on)
- Support packs are prepaid blocks (2/5/10 hours) that do not auto-renew
- You may cancel with 30 days written notice
- Unused hours are non-refundable unless we have not responded within our stated SLA
5) Chargebacks
If you initiate a chargeback without first contacting us to resolve the issue, we reserve the right to suspend services and dispute the chargeback with evidence of work performed.
6) Consumer rights
If you are a consumer, you may have additional rights under applicable consumer protection laws. Nothing in this policy limits rights that cannot be excluded by law.
