Terms of Use

These Terms of Use (“Terms”) govern your access to and use of https://bearpackonlineservices.com (the “Site”) operated by Tristan Salisbury (operating as BearPack Online Services, “BearPack”, “we”, “us”, “our”). By accessing or using the Site, you agree to these Terms.
If you do not agree, do not use the Site.

2) Site purpose
The Site provides information about our services, allows you to create an account, contact us, and make purchases. The Site may include:
- Informational pages about our services and pricing
- User accounts and login (including third-party authentication via Discord, Google, or similar providers)
- Digital products and subscription services (managed hosting, software access)
- AI-powered help chat for customer support
- Payment processing via Stripe for purchases and subscriptions
- Gated content and dashboards for authenticated users
Any custom development project work is governed by a separate written agreement (see the Service Terms and any proposal/statement of work/invoice you accept).
3) User accounts
- If you create an account, you are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You agree not to share your account with others or allow unauthorized use of your credentials.
- If you use third-party authentication (Discord, Google, etc.), you agree to their terms of service and privacy policies.
- We may suspend or terminate your account if you violate these Terms or engage in unauthorized use.
- We may terminate accounts that have been inactive for extended periods (notice will be provided where practical).
3a) Acceptable use
You agree not to:
- Use the Site in violation of any law
- Attempt to gain unauthorized access to the Site, accounts, or systems
- Interfere with Site availability (scanning, abusive scraping, DDoS attacks, etc.)
- Upload malicious code, viruses, or harmful content
- Misrepresent your identity or affiliation
- Use the Site for unauthorized commercial purposes (spam, phishing, etc.)
3b) User-submitted content
- If you submit files, messages, or content via contact forms, chat, or uploads, you represent that you have the right to share that content.
- We may use submitted content to improve our services, respond to inquiries, or fulfill contractual obligations.
- We will not train public AI models on submitted personal data (see Privacy Policy for details).
- Do not submit payment card details, passwords, or highly sensitive personal information via forms or chat. Use secure channels instead.
3c) Site availability and changes
- We aim to keep the Site available and functional, but we do not guarantee 100% uptime.
- We may modify, disable, or discontinue features or services at any time with reasonable notice where practical.
- We may perform maintenance, updates, or security patching that may temporarily interrupt availability.
- You are responsible for backing up critical data and understanding the current features available to you.
3d) Payments and subscriptions
Payments are processed by Stripe and are subject to Stripe's terms of service. Digital products and subscriptions are governed by our Refunds & Cancellation Policy and Product License Terms (if applicable). See those pages for details on cancellation, refunds, and billing.
4) Intellectual property
All Site content (text, graphics, logos, layout, and code) is owned by us or our licensors and is protected by intellectual property laws. You may view and use the Site for personal or business evaluation purposes, but you may not copy, reproduce, or distribute Site content without permission, except as permitted by law.
5) Third-party links and external content
- The Site may include links to third-party sites. We are not responsible for third-party content, policies, or practices.
- If you purchase or engage with external services linked from the Site, those services are governed by their own terms and policies.
- We are not liable for third-party outages, changes, or service interruptions.
6) Disclaimers and no warranties
The Site and its content are provided "as is" and "as available." We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Information on the Site is general and does not constitute legal, financial, or professional advice.
We do not guarantee specific business outcomes, revenue, conversions, or performance results from our services unless explicitly stated in a signed agreement.
7) Force majeure
We are not liable for delays or failures to perform caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, third-party service outages, internet infrastructure failures, government actions, or other unforeseen circumstances. In such cases, we will use reasonable efforts to notify affected users and resume service.
8) Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site.
9) Indemnity
You agree to indemnify and hold harmless BearPack from claims arising out of your misuse of the Site or violation of these Terms.
10) Changes
We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
11) Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts of Ontario.
